Terms of Use Policy

Agreement Between REEsults Coaching™ School of Real Estate and Users

You acknowledge and agree that by using REEsults Coaching, you are entering into a legally binding agreement (the "Agreement") with REEsults Coaching Located at 16616 Jackson Street, Omaha, NE 68118 (the "Company", "we", "our", or "us"), and that by becoming a "User", "Member" or "Viewer", you acknowledge that you have read and understood these terms and conditions and that you agree to be bound by all aspects of this Agreement (both in letter and in spirit) and held responsible for any violations thereof. By accepting the terms of this Agreement, you also verify that you have read and understand our Privacy Policy. This statement supersedes any prior agreements (both oral and written). If any section of these terms is found to be unenforceable either in law or in practice, the rest of the agreement in its entirety will remain in effect. Additionally, the unenforceable provision will be modified to render it enforceable and effective to the maximum extent possible, in order to effect the provision's intention. The Company's failure to enforce the Agreement does not constitute a waiver of the Agreement.


If you are using the Site as a representative for another company, that organization may have a separate agreement with us. However, as an individual user, you are bound by this Agreement regardless of any other agreements the Company may have entered into.


If you do not want to become a User, do not click "Register," submit any information, or view any of REEsults Coaching's content or pages.


NOTE: Included as part of this Terms of Use Agreement are legal/binding directives found in the following REEsults Coaching School of Real Estate  Code of Conduct, Privacy Policy, and School Catalog documents.

REEsultsCoaching.com reserves the right to offer in the future the ability to buy, sell or trade goods and services. This ability to buy, sell, or trade goods and services is available only to individuals who can form legally binding contracts under applicable law. This excludes, in all cases, minors (persons who have not reached their eighteenth birthday). 


REEsultsCoaching.com reserves the right to modify the Terms of Participation at any time and without prior notice to its Users. We may add to, change, delete, or end our or your use of our service at any time. The service may be temporarily unavailable for maintenance or other reasons. 


REEsultsCoaching.com cannot and does not control the behavior of the participants on this site. REEsultsCoaching.com does not assume responsibility for the content or context of the user comment areas and will not remove or edit postings to the public comment areas once they are entered into the service, except to expire records or in our sole discretion. 


The REEsultsCoaching.com service may be used only for lawful purposes. Transmission, distribution, or storage of material or conduct in violation of any applicable local, state, federal, or foreign law or regulation is prohibited. This includes, without limitation, any unauthorized use of material protected by patent, copyright, trademark, or other intellectual property right; material that is obscene, defamatory, or libelous; material that constitutes an illegal threat; material that violates rights of privacy or publicity; or material that violates export control laws. You may not use any information on our site without the prior written consent of REEsultsCoaching.com. 


Use of this website by you constitutes the grant of a license, not a transfer of title, and under this license, you may not: 

  1. modify or copy the materials; 
  2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial); 
  3. attempt to decompile or reverse engineer any software contained on this website; 
  4. remove any copyright or other proprietary notations from the materials; or 
  5. transfer the materials to another person or “mirror” the materials on any other server.


REEsultsCoaching.com prohibits the transmission, distribution, or posting of unwanted or offensive content. Prohibited transmissions include, without limitation, profane or sexually explicit language that includes masking or misspelling the words, or images that would be illegal in any jurisdiction. It is your responsibility, and you agree to comply with all requirements, legal or otherwise. Additional prohibitions include U.R.L. (Universal Resource Locator) or hyperlinks within a posting or image, pyramid or chain letters, fraudulent or criminal offers including but not limited to registering another email address other than your own, any posting with the goal of harassment of another, sexual requests from or for a minor, racial slurs or comments, harassment, unsolicited advertising (whether commercial or informational) and unsolicited email or advertisements including, but not limited to adult or dating services placing advertisements ("SPAM"). Further, REEsultsCoaching.com prohibits the transmission, distribution, or posting of any matter that discloses personal or private information concerning any person or entity, including, without limitation, phone number(s) or addresses, credit or debit cards, calling card, User account numbers/ passwords, or similar financial information, and home phone numbers or addresses. Even though all of this is strictly prohibited, there is a small chance that you might become exposed to such items, and you further waive your right to any damages (from any party) related to such exposure. 


REEsultsCoaching.com strongly opposes SPAM, which floods the Internet with unwanted, unsolicited emails and degrades the performance and availability of the REEsultsCoaching.com service. All forms of SPAM, and all activities that have the effect of facilitating SPAM, are strictly prohibited. 


REEsultsCoaching.com also prohibits the use of another Internet service to send or post SPAM to drive visitors to your site hosted on or through REEsultsCoaching.com systems, whether or not the messages were originated by you, under your direction, or by or under the direction of a related or unrelated third party. 


If REEsultsCoaching.com, in its sole discretion, determines that a violation of the Terms of Participation has occurred, REEsultsCoaching.com may pursue any of its legal remedies, including but not limited to the immediate deletion of any offending material from its site, cancellation of Your account, and /or the exclusion of any person(s) who may have violated any Terms of Participation. REEsultsCoaching.com could also pursue violators with claims alleging violations of various criminal and/or civil laws as applied by the relevant jurisdiction. REEsultsCoaching.com will cooperate with any investigation by any Federal, State, or local body or any court or tribunal legitimately exercising its rights. Such cooperation may be without notice to You. If REEsultsCoaching.com believes in its sole discretion that any user content or involvement with the site may create liability for REEsultsCoaching.com, REEsultsCoaching.com may take any actions that it believes are prudent or necessary to minimize or eliminate its potential liability, including but not limited to the release of User information. In sum, REEsultsCoaching.com reserves the right to refuse service to anyone at any time and to remove any listings or advertisements for any reason, without notice. 


Audio, Video Recording, and Content Duplication Policy

Audio/video recording and content duplication policies are governed by a patchwork of state and federal laws that focus on consent and the "reasonable expectation of privacy." 

To protect the privacy of class participants and the integrity of classroom discussions, audio and/or video recording of any classroom session or any duplication of Home Study course content is strictly prohibited without written permission from REEsults Coaching School of Real Estate owner, Mark Wehner.

This policy applies to all devices, including, but not limited to, mobile phones, tablets, laptops, smartwatches, recording devices, and any other technology capable of capturing audio, video, or images. Including the use of artificial intelligence (AI) tools used to duplicate, transcribe (i.e., voice-to-text software), and/or the sharing of proprietary course content and school information, including but not limited to social media. 


Legal and Copyright Protection Policy

All lectures, discussions, instructional materials, presentations, and classroom/Home Study course content are the exclusive intellectual property of REEsults Coaching School of Real Estate owner, Mark Wehner, and are protected by applicable copyright and intellectual property laws.


REEsults Coaching owner and staff reserve the right to enforce this policy. Any participant found to be recording or distributing course content without written authorization from the owner may be subject to:

  • Immediate removal from the course without refund
  • Denial of course completion or course educational credit
  • Possible legal action for violation of intellectual property rights
  • Reasonable accommodations under disability laws may apply. 
  • Nebraska is a "one-party consent" state, meaning you may ONLY record with the documented (written, email, or text) permission of the owner of the proprietary materials. 

By participating in any classroom/Home Study course, participants acknowledge that ignorance is no excuse for failing to obtain authorization. This information is publicly available online and is posted in both The REEsults Coaching's Terms of Use and Code of Conduct Policies.


Policy Regarding Classroom Scenarios, Case Studies, Professional Examples, Presentations, and Subject Content Delivered by Instructors


Purpose

This policy protects the teaching standards of the REEsults School of Real Estate, owned by Mark Wehner (hereinafter, the "school"), and the interests of its teachers, brokerages, licensees, clients, and others when examples and presentations are used to teach real estate law, rules, and practice.


Instruction may include made-up scenarios, modified real-life examples, and instructors' own experiences to illustrate how rules, laws, and broker practices apply within the school curriculum.


These instructional materials and discussions are presented solely for educational purposes and are not intended for public dissemination or external use.


Nature of Instructional Examples

During the course of instruction, instructors may present:


  • Hypothetical real estate transactions
  • Simulated case studies
  • Fact patterns illustrating the application of real estate law
  • Modified or anonymized examples derived from industry experience
  • Situational examples used to explain professional standards, compliance requirements, or risk management practices


Such instructional content may resemble real-world professional situations. Still, it shall not be interpreted by students as representing actual transactions, clients, licensees, or brokerage firms unless expressly stated by the instructor.


Examples may be changed, shortened, or anonymized to comply with school guidelines.


Confidentiality of Classroom Instruction

All class examples, case studies, and instructor-led discussions are private/proprietary school content.


Students agree that these materials are intended solely for school use and should not be shared or published outside class.

Students shall not:


  • Publicly disclose or repeat classroom scenarios in a manner that could identify or imply identification of a real transaction or person
  • Attribute classroom discussions or instructional examples to specific licensees, brokerage firms, or instructors
  • Use classroom content in public forums, social media, online discussions, podcasts, or other media
  • Represent classroom instructional examples as factual accounts of real events or professional conduct


Brokerage Authority and Professional Supervision

Students who are licensed real estate professionals or who may become licensed acknowledge that all real estate activities, including, but not limited to, professional communications, are subject to the supervision of their employing or designated broker.

Students shall not discuss or disclose instructional examples that could reasonably be interpreted as relating to real brokerage activity without the express knowledge and authorization of their employing or designated broker.


Classroom instruction forbids students from publicly interpreting, critiquing, or sharing brokerage practices, disciplinary issues, or professional conduct discussed during instruction.


Limitation of Reliance

Scenarios and discussions are educational. They do not count as legal advice, brokerage policy, regulatory interpretation, or professional guidance for specific transactions.


Students must consult their employing or designated broker, legal counsel, or regulatory authority about real estate law or brokerage policy in practice.


The school and instructors are not responsible for any use, misinterpretation, or sharing of classroom materials outside the educational setting.


Liability Disclaimer

The school, instructors, and staff are not liable for damages, claims, complaints, regulatory actions, or disputes from a student's disclosure, misrepresentation, public discussion, or improper reliance on classroom examples.


Students assume full responsibility for their conduct regarding the use or disclosure of instructional content.


Enforcement and Disciplinary Action

Violating this policy may lead to disciplinary action, including removal from the course, denial of credit, suspension, termination, or reporting to licensing or regulatory authorities.


The school reserves the right to enforce this policy to protect the integrity of its educational programs and the professional interests of instructors and industry participants.


Student Acknowledgment

By enrolling in or attending any course or event offered by the school, students confirm they have read, understand, and will follow this confidentiality and non-disclosure policy for all instruction and classroom materials.


Infringement and Remedies

If used without permission, the intellectual property owner(s) can pursue legal action. Remedies can include injunctions to stop the use of infringing items, impoundment and destruction of infringing data, and payment of monetary damages or loss of profits.


User understands and agrees that we may also, in our sole discretion, add or delete fees associated with the Service. 


DISCLAIMER OF WARRANTIES. YOU AGREE THAT THE USE OF THE SERVICE IS AT THE USER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND ON AN "AS AVAILABLE" BASIS. REESULTSCOACHING.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 


REESULTSCOACHING.COMMAKES NO WARRANTY THAT THE SERVICE WILL MEET USERS' REQUIREMENTS, THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; NOR DOES  MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED FROM THE SERVICE. 


USER UNDERSTANDS AND AGREES THAT ANY INFORMATION OR MATERIAL AND/OR GOODS OR SERVICES OBTAINED THROUGH THE SERVICE ARE DONE AT THE USER'S OWN DISCRETION AND RISK AND THAT THE USER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE RESULTING FROM THE USE OF THE SITE. 


NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY USER FROM REESULTSCOACHING.COM OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN. 


LIMITATION OF LIABILITY. USER AGREES THAT NEITHER REESULTSCOACHING.COM NOR ANY OF ITS PROVIDERS OF INFORMATION SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA OR ARISING FROM ANY OTHER MATTER RELATING TO THE SERVICE, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF REESULTSCOACHING.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. USER FURTHER AGREES THAT REESULTSCOACHING.COM SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM INTERRUPTION, SUSPENSION, OR TERMINATION OF SERVICE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, WHETHER SUCH INTERRUPTION, SUSPENSION, OR TERMINATION WAS JUSTIFIED OR NOT, NEGLIGENT OR INTENTIONAL, INADVERTENT OR ADVERTENT. USER AGREES THAT REESULTSCOACHING.COM SHALL NOT BE RESPONSIBLE OR LIABLE TO USER, OR ANYONE, FOR THE STATEMENTS OR CONDUCT OF ANY THIRD PARTY OF THE SERVICE. IN SUMMARY, IN NO EVENT SHALL REESULTSCOACHING.COM BE LIABLE TO YOU FOR DAMAGES, LOSSES, AND CAUSE OF ACTIONS EXCEEDING THE AMOUNT PAID BY YOU TO REESULTSCOACHING.COM, IF ANY, THAT IS RELATED TO THE CAUSE OF ACTION.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF WARRANTIES OR OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. 


You give us a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable (through multiple tiers) right to exercise all copyright and publicity rights, in any existing or future media, known or unknown, over the material or User Data displayed in Your postings. For the purpose of this Agreement, "User Data" shall mean all information (if any) submitted by You (the "User") to REEsultsCoaching.com with the exception of credit card numbers, checking account numbers, etc. "Individually Identifiable User Data" shall mean that subset of "User Data" which can be reasonably used to identify a specific individual, such as their name, address, phone number, etc. The User Data shall be deemed to be the property of REEsultsCoaching.com. You shall take all reasonable efforts to ensure that it is accurate and complete and not misleading in any way. 


No Resale or Unauthorized Commercial Use
You agree not to resell or assign Your rights or obligations under these Terms of Participation. You also agree not to make any unauthorized commercial use of the Service. 


Others' Information
You agree not to make use of anyone else's Information other than as necessary to participate in REEsultsCoaching.com and to promptly complete any REEsultsCoaching.com transactions in which you are involved. 


No Agency
There is no agency, partnership, joint venture, employee-employer, or franchisor-franchisee relationship between REEsultsCoaching.com and any User of the Service. 


Notice
Any notice to You or to us shall be made by either email or regular mail. We may also give notice of changes to these Terms of Participation or other matters related to REEsultsCoaching.com by displaying notices to Users on the Service. 


This Agreement is the complete and exclusive agreement between the parties with respect to the subject matter hereof, superseding any prior agreements and or communications regarding such subject matter. This Agreement may only be modified, or any rights under it waived, by a written document executed by both parties. 


These Terms of Participation and the relationship between User and REEsultsCoaching.com shall be governed by the laws of the State of Nebraska, without regard to its conflict of laws principles. User and REEsultsCoaching.com agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Omaha, Nebraska. 


The failure of REEsultsCoaching.com to exercise or enforce any right or provision of these Terms of Participation shall not constitute a waiver of such right or provision. If any provision of these Terms of Participation is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms of Participation shall remain in full force and effect. 


User agrees that, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms of Participation must be filed within six (6) months after such claim or cause of action arose or be forever barred.
